NEW YORK (Reuters) – An attorney for President Donald Trump's son Eric on Wednesday urged a New York State judge not to require him to open a state investigation into the financing of real estate owned by the company before the November 3 presidential election his family is interviewed.
At a hearing in the Manhattan Supreme Court, Eric Trump's attorney, Alan Futerfas, said his client, an executive vice president of the Trump Organization, was an "integral and integral part" of his father's re-election offer and his almost daily travels.
He said he and another lawyer joined the case in late July and needed time to review the "enormous amount of material" involved in the investigation.
However, an attorney for New York Attorney General Letitia James denied Eric Trump's efforts to postpone his deposit, which that office requested in a May 26 subpoena, to November 19 or later.
"There's just no reason … a witness can prevent the attorney general's investigation into personal inconvenience for six full months," attorney Matthew Colangelo said. "Mr. Trump shouldn't be able to benefit from his own dilatation behavior."
James conducted a civil "potential fraud or illegality" investigation to determine if Donald Trump and the Trump Organization overstated the value of assets for credit and tax breaks.
Their investigation began after Donald Trump's former personal attorney and fixer Michael Cohen told Congress that the president inflated some assets to save money on loans and insurance and dumped other assets to lower property taxes.
James said Eric Trump canceled a scheduled interview in July after an attorney objected that her office's questions "were beyond the scope of her civil investigation."
Judge Arthur Engoron is looking into the timing of Eric Trump's testimony and whether the Trump Organization and its outside lawyers will need to give James documents they deem privileged.
